What is a Section 7.12 Development Contribution formerly known as Section 94A (S94A) contributions?

Developments that lead to an increase in the local population, visitation or traffic will usually be required to pay development contributions. These contributions are known as Section 7.12 of the Environmental Planning and Assessment Act 1979.

Council will invest the funds collected from development contributions to upgrade infrastructure, services, recreation and community facilities, to support the growth of developed areas.

Development Contributions

Council has two plans relating to development contributions.

1. Developer Contribution Plan (Fixed Levy - Section 7.12)

Leeton Shire Council adopted the Developer Contribution Plan (Fixed Levy - Section 7.12)(PDF, 366KB) on 1 June 2023.

The Plan applies to all development throughout Leeton Shire over $100,000.

Please read the Developer Contribution Plan (Fixed Levy - Section 7.12)(PDF, 366KB) and attach the relevant cost summary form to your Development Application.

2. Section 64 Peripheral Plan

The Leeton and Yanco Peripheral Area Contributions Plan(PDF, 417KB)  remains active in regard to Section 64 of the Local Government Act 1993 and Division 2 of Part 3 of the Water Supply Authorities Act 1997. 

Planning Agreements

Section 7.4, Subdivision 2 of the Environmental Planning and Assessment Act 1979 makes provision for Council to enter into Voluntary Planning Agreements as the means through which these additional community facilities are provided. Under these agreements, Council enters into a legal contract with a developer to construct public facilities and infrastructure or provide public services as part of the conditions of development consent.

Section 206 of the Environmental Planning and Assessment Regulation 2021 states that a Council must keep a planning agreement register.

Council must keep a record of the following in its register:

  • a short description of any planning agreement (including any amendment) that applies to the area of the Council,
  • the date the agreement was entered into,
  • the names of the parties, and
  • the land to which it applies.
